Total Care Pharmacy ("TCP"), understands the importance of protecting your privacy. TCP is dedicated to upholding its obligations at law concerning the collection, use and disclosure of the personal information under its control, as set out in the Personal Information Protection Act and Regulations and the Health Information Act and Regulations of Manitoba, as well as the Personal Information Protection and Electronic Documents Act and Regulations of Canada.

This Policy explains how TCP collects, uses and discloses the personal information collected from and provided by its customers while using TCP's services and/or its Web site (the "Main Site"). Any personal information collected or provided to us, including through the Main Site, will be treated with care in accordance with this Privacy Policy and will not be used or disclosed in ways to which you have not consented or where prohibited by law.

PLEASE NOTE that, in addition to the terms set out in the Privacy Policy, all Order information provided to us on the site where you place an order (the "Secure Site") will be subject to the terms set out in the Customer Agreement, which you should review prior to providing the information required.

The Main Site and Secure Site are collectively referred to as the "Site".

By using the Site, you signify that you have consented to the collection, use, and disclosure of your personal information in accordance with the TCP Privacy Policy. If you do not agree with this Policy, you are prohibited from using the Site.

TCP adheres to the following principles concerning the collection, use and disclosure of personal information, namely:

Accountability

TCP is responsible for the personal information under its control and has appointed a Privacy Officer to be accountable for its compliance with its obligations at law and its Privacy Policy. Should TCP transfer personal information to a third party for processing or a related business purpose, it shall use contractual means to bind the party to its privacy obligations at law.

Identifying Purposes

TCP shall document the purpose for which personal information is required at or prior to the time of collection.

Consent

TCP acknowledges that the knowledge and consent of an individual are required for the collection, use or disclosure of personal information, except where required or permitted by law. TCP recognizes that an individual may withdraw or vary consent as permitted by law.

Limiting Collection

TCP shall collect only that personal information necessary to complete its purposes. TCP shall collect information directly from the individual who is the subject of the information except where permitted by law.

Limiting Use, Disclosure and Retention

TCP shall not use or disclose personal information under its control for purposes other than those for which it was collected, except with the consent of the individual or where permitted or required by law. TCP shall keep personal information on file in accordance with its professional and legal obligations.

Accuracy

TCP shall take reasonable steps to ensure that the personal information it has on file is accurate, complete and up-to-date as is necessary for the purpose for which it is used.

Safeguards

TCP shall employ sufficient safeguards to reasonably protect the personal information under its control from unauthorized access, use or disclosure. TCP shall educate its employees concerning TCP's privacy obligations.

Openness

TCP shall make a complete copy of its Privacy Policy, along with the TCP Privacy Officer's contact information, available to consumers upon request.

Individual Access

Pursuant to certain restrictions or exceptions at law, TCP shall provide an individual with access to their personal information maintained on file by TCP in accordance with its obligations at law and its Privacy Policy. Should an individual note that there is an error or omission in their personal information on file with TCP, upon reasonable notice and justification, his or her personal information will be updated as appropriate.

Challenging Compliance

An individual may challenge TCP's compliance with its obligations concerning its management of personal information and shall address complaints in accordance with the provisions set out in TCP's Privacy Policy.

Personal Information

By using the TCP Site or its services, you Specifically Provide that:

During your use of the Site, you may decide to voluntarily provide personal information such as your name, e-mail address, postal address, and telephone number when asked for purposes such as communicating with TCP. TCP may use your personal information to contact and correspond with you, to respond to your inquiries, and as otherwise permitted by law. If you provide your e-mail address, TCP may send to you, from time to time, e-mail containing information about TCP and other matters it believes will be of interest to you. Personal information provided to place an order on the Secure Site will be protected as stated in the privacy provisions of the Customer Agreement.

Disclosure of Your Personal Information

If TCP is involved in a merger or other reorganization, TCP may disclose your personal information to the resulting organization. Also, TCP must cooperate fully should a situation arise where TCP is required by law or a legal authority to release your personal information. TCP takes reasonable precautions to avoid the unauthorized disclosure of your personal information. Nevertheless, due to the nature of the Internet, security and privacy risks cannot be entirely eliminated. Therefore TCP cannot guarantee that your personal information will not be disclosed in ways not otherwise described in this Policy.

Tracking Information

TCP may use and share with our partners non-personal statistical or demographic information which cannot be connected to the identities or other personal information of individual users for research purposes.

Other Matters

The Site may contain links to other Web sites which collect information about you voluntarily or through cookies. TCP has no responsibility or liability for or control over those other Web sites. This Privacy Policy may be changed by TCP from time to time in TCP's sole discretion and without any prior notice or liability to you or any other person. New versions of this Privacy Policy will be posted here and you should check for Policy updates.
